Terms of Service

The terms that govern your use of TinyDesk, including credits, payments, refunds and acceptable use

These Terms of Service ("Terms") govern your use of TinyDesk, the website at tinydesk.cc and its related services (the "Service"), operated by TinyDesk ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

TinyDesk is an AI video tool. You upload a photo, and we use third-party AI models to generate a short video in which the person in the photo appears to sing lead at an intimate "desk concert", with an AI-generated band, vocals and audio. Videos are delivered digitally in your account.

All videos are AI-generated and are not real footage. Results vary: the generated person, voice, band, movements and lip sync may not match the photo or your expectations exactly.

Eligibility and Accounts

You must be at least 18 years old, or the age of majority where you live, to use the Service. You are responsible for keeping your login details secure and for all activity under your account. You must give us accurate information, including a working email address.

Credits and Payments

  • Videos are paid for with credits. The number of credits each video costs is shown on the site before you generate it.
  • Credits are sold in packs as one-time purchases. There are no subscriptions and no automatic renewals.
  • Prices are shown in US dollars. Payments are processed by Stripe. Applicable taxes may be added at checkout.
  • Credits do not expire, have no cash value, cannot be transferred or resold, and can only be used on TinyDesk.
  • We may change prices or credit costs for future purchases. Changes never affect credits you have already bought.

Refund Policy

  • Failed renders. If a video fails to generate, the credits for that video are returned to your balance automatically.
  • Unused credit packs. You may request a full refund of a credit pack within 14 days of purchase, as long as none of the credits from that purchase have been used. Email support@tinydesk.cc from your account email with your purchase date.
  • Used credits. Credits that have been spent on videos, including videos you are unhappy with, are not refundable, except where the law requires otherwise.
  • Refunded purchases. When a purchase is refunded, the credits from that purchase are removed from your balance.
  • Chargebacks. Please contact us before disputing a charge with your bank. We may suspend accounts with fraudulent or abusive chargebacks.

Acceptable Use

You may only upload photos that you have the right to use. By uploading a photo, you confirm that:

  • the photo shows you, or an adult who has given you permission to use their likeness in this way;
  • the person in the photo is at least 18 years old;
  • the person is not a celebrity, politician or other public figure.

You must not use the Service to:

  • create sexual, nude, sexually suggestive or otherwise explicit content;
  • depict minors in any way;
  • impersonate, defame, harass, bully or threaten anyone;
  • create content intended to deceive people into believing it is real footage, including political or news-related deception, fraud or scams;
  • infringe anyone's copyright, trademark, privacy or publicity rights;
  • break any law, or try to bypass our safety filters, rate limits or security.

When you share a video, do not remove or hide the fact that it is AI-generated where doing so would mislead people. We and our AI providers use automated safety filters, and we may refuse, remove or block any content and suspend accounts that break these rules.

Your Content and Videos

You keep ownership of the photos you upload. You give us a limited licence to store, process and transmit your photos, and to send them to our AI providers, only to create your videos and run the Service.

Subject to these Terms and to the rights of the person shown, you may download and use the videos you generate for personal and commercial purposes. We do not claim ownership of your videos. We do not use your photos or videos to train AI models, and we do not publish them in a public gallery or use them in our advertising without your permission.

Third-Party Names and Non-Affiliation

TinyDesk is an independent tool. It is not affiliated with, endorsed by or connected to NPR, NPR Music or the Tiny Desk Concerts series. "Tiny Desk" may be a trademark of its respective owner and is used only to describe the style of video that is popular online. Names of AI models and providers belong to their owners.

Availability and Changes to the Service

We work to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free. Generation times depend on third-party providers. We may change, suspend or discontinue features of the Service. If we shut the Service down permanently, we will refund unused credits from purchases made in the previous 12 months.

Suspension and Termination

You can stop using the Service at any time and delete your account in Settings. We may suspend or close your account if you break these Terms, misuse the Service or create legal risk for us or others. If we close your account because you broke these Terms, unused credits are not refunded.

Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We are not responsible for how you or others use the videos you create.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

Changes to These Terms

We may update these Terms. If we make material changes, we will update the date at the top and, where appropriate, notify you by email or on the site. Continuing to use the Service after changes take effect means you accept the updated Terms.
